Plain terms for using the Curing Insomnia: Fall Asleep app. By downloading or using it you agree to them.
The app is published by Nattapon Kittisuphat ("we", "us") on the Apple App Store. Apple's standard Licensed Application End User License Agreement also applies; where the two differ for your use of the app, these terms add to it.
1. What the app is
A player for relaxing sounds with a sleep timer, reminders and general sleep information. It is not a medical device, does not diagnose or treat insomnia or any other condition, and is not a substitute for a doctor. If poor sleep lasts for weeks or affects your day, talk to a clinician.
2. Using the app
- Use it for personal, non-commercial purposes.
- Do not copy, modify, reverse engineer or redistribute the app, its sounds or artwork.
- Keep the volume at a safe level, especially with headphones and when sleeping.
3. Subscriptions and purchases
The app is free to download. Optional purchases include the Plus yearly subscription, a lifetime unlock, room passes and themes. Prices are shown in the app before you buy and can vary by country.
- Payment is charged to your Apple ID when you confirm the purchase.
- Plus renews automatically each year unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
- Free trial: Plus may start with a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, the yearly subscription starts and is charged. Any unused part of a free trial ends when you buy a subscription.
- Manage or cancel in iOS Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for.
- Refunds are handled by Apple under its policies: reportaproblem.apple.com.
- One-time purchases are yours on every device signed in with the same Apple ID; use "Restore Purchases" in the app's Settings.
4. Ads
The free version shows ads, as described in the privacy policy. Rewarded ads that unlock a theme or room for 24 hours are always optional.
5. Ownership
The app, its sounds, artwork, text and code belong to us or our licensors and are protected by copyright. Buying an item gives you a personal licence to use it in the app, not ownership of the content.
6. No warranty
The app is provided "as is". We work to keep it reliable, but we do not promise it will be error-free or always available, or that it will improve your sleep. Do not rely on the app as your only alarm for anything important.
7. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages from using the app. Our total liability is limited to the amount you paid for the app in the 12 months before the claim. Nothing here limits rights you have under consumer law that cannot be waived.
8. Changes
We may update these terms; the date at the top shows the latest version. Continuing to use the app after a change means you accept the updated terms.
9. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where your local consumer law says otherwise.
